Consumers involved in the class-action lawsuit believe their phone’s performance suffered after installing an Apple software update. They say Apple’s publicity misled them into believing that their phones were nearing the end of their life cycle and needed a new phone or battery replacement. Apple largely attributed the issues to temperature changes, high usage and other issues, and said its engineers quickly resolved them.
Lawyers representing consumers said the settlement was “fair, reasonable and appropriate.” They called the $25 per iPhone “considerable by any measure,” after damages experts suggested that $46 per iPhone might be the maximum.
Lawyers plan to seek up to $93 million in attorney’s fees, or 30 percent of the $310 million, plus up to $1.5 million in other fees. After an initial outcry from consumers about slowing down the iPhone, Apple apologized and lowered the price of a replacement battery from $79 to $29. (small)
